In a significant ruling, Birchcliff Energy Ltd., an oil and gas exploration and development firm, entered a guilty plea on August 14 at the Grande Prairie Court of Justice. The plea was in response to a violation of the Occupational Health and Safety (OHS) Act concerning the safety of a worker. This legal action arose from a tragic incident that took place on October 10, 2023, at an oil and gas site located west of Spirit River, Alberta. During this incident, a worker lost their life after falling into a reservoir while attempting to collect water samples.
Following the guilty plea, the court imposed a financial penalty of $200,000 on Birchcliff Energy Ltd. The funds are designated for Energy Safety Canada, which will utilize this amount to create an industry awareness and training program specifically aimed at mitigating risks associated with serious injuries and fatalities in operations involving surface water.
Additionally, the court mandated a payment of $112,500 to Saddle Hills County Protective Services. This sum is intended to support the development of training focused on surface ice water rescue and to assist in acquiring necessary equipment for ice water rescue operations.
As part of the legal proceedings, all remaining charges against Birchcliff Energy Ltd. were withdrawn, marking a significant moment for the company. Furthermore, both Birchcliff and the Crown now have a period of up to 30 days to consider an appeal against the conviction or the penalties imposed.
