Moffat Bros. Roofing Ltd. has been fined after a worker fell from a roof during a project in Port Hope, resulting in critical injuries.
In Cobourg, Ontario, Moffat Bros. Roofing Ltd. has faced a significant penalty of $100,000 following an incident that occurred in August 2023, which left a worker injured. The incident took place on August 1, 2023, during a steel roof replacement project located in Port Hope. According to reports from an Ontario court bulletin, the worker was secured to a safety line, but the tether rope was not sufficiently long to allow access to the area necessary for the installation of the final roof panel. In a bid to continue working, the worker unclipped from the safety line. Subsequently, while attempting to step over a steel panel that was being fastened to the roof, the worker lost their balance and fell approximately 22 feet to the ground, suffering critical injuries. At the time of the fall, the worker was not utilizing any fall protection methods, despite the presence of appropriate equipment on site. The court found that Moffat Bros. Roofing Ltd. failed to enforce the proper safety measures and procedures as mandated by section 26.1(2) of Ontario Regulation 213/91, which is a violation of section 25(1)(c) of the Occupational Health and Safety Act. Following the company’s guilty plea in the Provincial Offences Court in Cobourg on June 3, 2026, Justice of the Peace Joel Kulmatycki imposed the financial penalty on the company.
