The incident involved the company performing excavation work to install a new underground utility service at a residential site. During this operation, workers were tasked with exposing an existing pipeline when heavy rainfall unexpectedly began. This rainfall mixed with silt and soil, leading to a dangerous accumulation of slurry in the trench where a worker was positioned.
As the weather worsened, the slurry formed rapidly, creating a hazardous environment. Unfortunately, the worker became trapped in the mixture and suffered fatal injuries due to the rising water levels. The incident prompted an investigation by the Ministry of Labour, Immigration, Training and Skills Development, which evaluated the engineering aspects of the trench, the pumping capacity, and the overall conditions of the site at the time.
The investigation concluded that the volume of rainfall, combined with the sediment that entered the excavation, rendered it impossible to safely dewater the trench. It was determined that continuing to operate equipment under these adverse weather conditions posed a significant risk to the worker's safety. Consequently, Aecon Utilities Inc. was found to have violated the Occupational Health and Safety Act by failing to ensure that equipment was not used when weather conditions could likely jeopardize worker safety.
After a guilty plea was entered in the Ontario Court of Justice in Newmarket on March 26, 2026, Justice Prutschi imposed the fine on the company.
