Excel Management and Benchmark Cribbing Fined for Safety Violations in Calgary Incident

As the prime contractor, Excel Management Limited Partnership faced one count for failing to ensure that its workers received adequate training to conduct their tasks safely. In addition to this count, three other charges against Excel Management Limited Partnership, its associated company Excel G.P. Benchmark Cribbing Inc., acting as an employer, also pleaded guilty to one count for not ensuring that the racks used for storing materials or equipment were placed on stable foundations capable of supporting the necessary loads. Similar to Excel, the Crown withdrew three additional charges against Benchmark Cribbing as part of the agreement.
Furthermore, a stay of proceedings was issued against a third defendant in connection with this case. The legal consequences for both Excel and Benchmark include a financial penalty totaling $250,000, which encompasses a 20 percent victim fine surcharge. The payment structure requires that Excel G.P. Ltd. pay its portion of the fine immediately, while Benchmark Cribbing has until December 23, 2026, to settle its fine.
